​Terms of Service, Website Usage, and Digital File Ownership Agreement :

By utilizing the services of Internal Hero.com you are acknowledging that YOU are ordering the artwork for YOURSELF providing YOUR PICTURE/LIKENESS as a reference and not that of any other person.

By placing an order with InternalHero.com you as the customer also acknowledge that you are AT LEAST 16 YEARS OF AGE. If you are 16 or 17 years of age you MUST have your parents permission and consent to use and place orders with Internal Hero. If you are not at least 16 years of age you understand that, at this time, the services of InternalHero.com cannot be offered to you. InternalHero.com reserves the right to refuse any order request for any reason it deems necessary.


By placing an order with InternalHero.com you as the customer grant InternalHero.com the right to create artwork with your face and likeness for your order without any penalty whatsoever by doing so.

By selecting the Online Community option you as the customer grant InternalHero.com the right to display and distribute your drawn face and likeness as a direct result of your particular art order throughout it’s various forms of social media, printing, publications, and merchandising without compensation and without penalty whatsoever.

The artwork created from any order placed with InternalHero.com, except for the face and likeness of the customer, is the intellectual property of the copyright and trademark owner of InternalHero.com G.R.O'Neil, and therefore can be used by InternalHero.com for any promotional and commercial purpose whatsoever so long as the customer’s face is removed, otherwise hidden from display, or omitted.

PLACING AN ORDER AT THE INTERNALHERO.COM WEBSITE AND ACCEPTING THE ARTWORK FROM AN ORDER, AND ANY THIRD PARTY RECEPIENT OF AN INTERNALHERO IMAGE ART ORDER SIGNIFIES THAT YOU AND THE RECIPIENTS HAVE READ, UNDERSTAND AND AGREE TO THESE TERMS.

Upon sharing your order via replication of the digital file to give to others, you as the customer accept the responsibility to relay these terms to those third party recipients. The recipients in turn , upon accepting the file, take on the same responsibility should they choose to share the artwork file with additional parties.

All images displayed on the InternalHero.com website and all images created as a result of the services offered by this website shall have no derivative works or altered versions created based directly from them or the distinct likenesses thereof. All images displayed on the InternalHero.com website and those created as a result of requested orders shall not be used commercially or for profit generating purposes IN ANY WAY by the customer or any third party without the strict written consent of the intellectual property owner G.R.O’Neil.

(All terms are applicable for customers placing orders from InternalHero.com and any third party recipient who chooses to accept or own a copy of a digital artwork file originally created directly from an InternalHero.com order.)

InternalHero.com will not be held responsible for any undesired results or damages for providing these illustration, caricature, and product designing services whatsoever. By requesting this service, you the customer are giving InternalHero.com the right to create your likeness in cartoon or illustrated form without legal penalty of any kind, especially if your likeness or image is otherwise used in the public domain to generate income.

What you as the customer can, and cannot do with the InternalHero.com artwork and digital file you order (or receive as a third party via sharing) includes , but are not limited to the following:

CAN:
The customer who receives an order that they requested for self in which the customer requesting the order is the same individual as the person provided in reference pictures and drawn for the order can post that order themselves created by InternalHero.com for purposes of “fair use” as recognized by Copyright Law. When the customer who requested the order is the same individual that is drawn for the order, that customer can engage in “fair use” with the imagery provided from the order for the purposes of informing, commentary discussion of the content and services of InternalHero.com to the public in public forums,
provided that the presentation of the artwork/text follows all display guidelines addressed in this agreement (example: No derivative alterations: no altering content or deleting content from the art order. See “CAN’T” section below).

The customer can post their own order within the various outlets of social media whose terms do not compromise or conflict with the fact that InternalHero.com owns all the intellectual property rights to all the images within the work, except for the customer’s facial likeness that has been created with permission.

InternalHero.com is hereby NOT RESPONSIBLE IN ANY WAY for the use of image orders distributed by the customer via sharing to and by third party recipients in ways that the original customer does not condone or approve of.

​The customer can reproduce digital file to share with others for personal use only and personal display (not for profit or sale/resale in any way by any party without clear written consent of trademark and copyright owner, G.R.O’Neil)​

InternalHero.com is not responsible for the state/condition of file duplication or copies that result from personal sharing by the initial customer of an order to all other third parties, and is not responsible for absolutely any undesired event or damages resultin from the duplication, distribution, and sharing of the image files from the initial customer to any third parties whatsoever ( and any and all sending and receiving parties that follow after that. ). It is the customer’s responsibility to share with any third party recipient he/she chooses to share their order file of these terms and conditions that apply here.

That responsibility in turn is transferred to the recipient of the file via personal sharing, and thus that recipient also has the responsibility to make aware these terms and conditions stated here to those additional parties with whom they choose to share the file, and so on.

Third party users who share or receive InternalHero.com imagery and files that were not sent directly from official InternalHero.com sources do so at their own risk.

Customers can post artwork on social media networks (blog posts, avatars, public picture sharing websites, etc.) as long as intellectual property credit is either recognizable/readable in the artwork itself or typed nearby the displayed art as follows (direct links to InternalHero.com website preferred along with copyright and trademark credit.) :

Customers can use the artwork created from an order for personal display as a screensaver or digital device wallpaper as long as copyright and trademark credit within the artwork is visible, or identified clearly in some way.
​
Customers can print the artwork created from an order on paper (or similar materials used for physical poster like display) for personal use as long as copyright and trademark credit of G.R.O’Neil (and any disclaimers if included) are clearly visible within the artwork. (This does not include applying artwork/text from an order to stickers, mugs, T-shirts, buttons, pins, and any other form of similar merchandise.)

Customers can increase or decrease the scale of entire image for personal use (without cropping, adding ,altering or removing existing imagery, text, or copyright and trademark credits).
​
CAN’T :
​
Customers and third party image file recipients cannot print imagery/text generated from an InternalHero.com order for resale or profit of ANY KIND. Cannot print or electronically reproduce art order for mass distribution of a business nature/purpose ( profit generating, promotional giveaways , or advertising a product or service other than that by and/or for InternalHero.com) in ANY form. (Cannot print to use to advertise any customer’s or third party recipient’s (or any parties thereafter) business venture; especially that which is in (but not limited to) direct conflict with that of InternalHero.com or any services provided or shared in the same genre as InternalHero.com)

Customers and third party file recipients cannot alter the self contained content of visual imagery or text delivered by InternalHero.com in any way, shape, or form (save voluntarily changing scale: making the image larger or smaller). These acts include (but are not limited to) adding imagery/text or removing imagery/text from a delivered order (this includes , but not limited to, the act of re-cropping any part of imagery/text to omit elements delivered in the original version; especially intellectual property and usage disclaimers.) Resizing the entire image by scale (increase or decrease size of entire image without cropping) is acceptable.

Altering the imagery/text of any artwork order created by InternalHero.com for any purpose ( even for purposes of parody, and especially to disparage or humiliate any individual) is strictly prohibited. InternalHero.com will not be held responsible whatsoever for such occurrences.

Customers and third party file recipients cannot apply images/text from any InternalHero.com order to T-Shirts, Mugs, Buttons, Stickers, Posters, Digital Applications as a permanent fixed element to be commercially distributed , and all other forms of merchandise –digital , electronic, or physical in nature, intended for mass distribution for any purpose (profit motivated or not) without strict written consent and special license from copyright and trademark owner G.R. O’Neil.

Customers and third party file recipients cannot redistribute an image produced from an InternalHero.com order with intent to resell, or as any free promotional giveaway of a business nature whether digitally, electronically , or physically.

Customer and third party recipients cannot create derivative stand alone works , physical or digital, that duplicate any order (or a portion of any order) created by InternalHero.com . Any derivative copies of visual imagery/text recreated freehand or otherwise by outside parties that clearly and arguably originated in composition, color, text, imagery, sequential events, text, etc. from any order created by InternalHero.com is, upon creation, intellectual property of InternalHero.com and is subject to copyright and trademark ownership law. (This does not include ownership of a customer’s facial likeness, but does include all other imagery including the distinguishable costumes and clothing that a customer’s character wears in the illustrations provided for an order. The dialogue spoken by the customer’s character is also the intellectual property of InternalHero.com and the copyright/trademark owner. ).

General notice to all customers, and third party digital file recipients as a result of sharing:

InternalHero.com is hereby not responsible for any damages or undesired events that result from a customer’s, or third party recipient’s (and any other party recipient thereafter) failure to abide by this agreement concerning all InternalHero.com intellectual content and digital file sharing, receiving, and file ownership.

Internal Hero.com Community Participation:
​
“InternalHero.com Community Participation”
A customer’s adventure order may be presented/featured in our various forms of social media as
well as featured in printed publications, during and after creation. Thus becoming a part
of the “Internal Hero Universe. “
​
POSSIBLE BENEFITS INCLUDE:
* Possible real time work in progress updates through displays of the pencil
Sketch process, inking process ,coloring process, or other stages of your order’s
development , often in real time via blog posts, podcasts, social media sharing, or later in
publications, etc.
* Mass distribution of a customer’s order to all Internal Hero.com
enthusiasts via podcast, blog posting, printed publications, newsletters, etc.
in some cases in products and publications sold for profit by Internal Hero with the understanding that there is no compensation monetary or otherwise whatsoever for such inclusion.

The customer’s name that selects the Internal Hero.com community option may be
mentioned or displayed if the customer gives clear consent via written documentation by e-mail or otherwise.
​
The customer's social media account title/handle will be shared within Internal Hero's various social media accounts as a means to connect with the customer and show the customer the progress of their order if Community Participation option is selected. InternalHero.com will not be held responsible for any damages as a result of sending a message to a customer's social media account in order to share the creation process, progress and completion of any order online via social media. InternalHero.com will not be held responsible for any damages as a result of displaying an illustrated art order in any other public display form or publication, if the customer chooses the Community Participation option.​

IMPORTANT NOTE: Actual real pictures of real faces will never be used in our
social media avenues & correspondence, or printed publications unless clear written consent of the customer has been given and documented (for example: Where positive testimony of services is given by a customer InternalHero.com may request customer’s consent to share their photo image and would only be done with documented customer agreement.)

Otherwise, only the super hero caricature versions of a person’s likeness created as a result of orders will be
shared, distributed, or displayed as a result of choosing Community Participation. There is no compensation whatsoever (financial, action oriented, or otherwise) from the result of choosing this particular option of Community Participation.)

Note that ALL IMAGERY from ALL ORDERS created by InternalHero.com are subject to repeated commercial use by InternalHero.com in any way InternalHero.com chooses whatsoever, including, but not limited to, images from one order being used for the creation of another art order especially in the case where the customer’s likeness is either removed, omitted , or concealed. This is due to the fact that Internal Hero.com claims and retains all intellectual property rights to the content created in any and every given order filled for the customer (excluding the customer's facial likeness) , and reserves the right to re use and re apply said imagery (excluding the customer's facial likeness) in any way, including, but not limited to repeated use within new art orders,​ new products, and advertising.
